♦ Why This Information Is Important To You
The Personal Information Protection and Electronic Documents Act ("PIPEDA") is Canada's private sector privacy legislation. It came into force on January 1, 2001 for the federally regulated private sector and has been made binding upon the provincially regulated private sector since January 1, 2004. It places strict limits on how organizations may collect, use, disclose and retain personal information.
The fundamental tenet of PIPEDA is that informed consent must be obtained before collecting, using and disclosing personal information.
In December 2010, Parliament passed amendments to the legislation, which was originally passed in 2000. The amendments, which were included in legislation to curb unwanted commercial solicitation by e-mail or other electronic formats (also known as spam), also broaden certain powers of the Privacy Commissioner.
